1. Agreement to Terms

Welcome to Q-Ledger. These Terms and Conditions ("Terms") govern your use of the Q-Ledger mobile application and any related services (collectively, the "Service"), provided by Aernoud Dekker (the "Developer"). By downloading, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Description of the Service

Q-Ledger provides a non-custodial software interface that enables users to securely store encrypted cryptocurrency private keys on Arweave's permanent distributed storage network. The Service enables you to:

Store Private Keys: Back up cryptocurrency private keys in multiple formats using quantum-resistant encryption.
Retrieve Encrypted Data: Access your encrypted backups from any iOS device at any time.
Secure Sensitive Documents: Store any sensitive information with quantum-safe encryption and permanent storage.

The Service is an interface only. We do not store, control, or have custody over your private keys, encryption keys, data, or digital assets.

3. No Legal, Financial, or Tax Advice

Q-Ledger is a technology tool. The Service does not constitute legal, financial, security, or tax advice. You are solely responsible for seeking professional advice from qualified experts in your jurisdiction.

4. User Responsibilities

4.1. Encryption Key and Backup Responsibility

Your encryption keys control access to your backups. You are solely responsible for the security and backup of your quantum-safe encryption keys. We have no ability to access or recover them.

For Standard users, X-Wing keys sync automatically via Apple iCloud Keychain (if enabled).
For Pro users, you may optionally export and securely store your ML-KEM-768 key.
If you lose access to your encryption keys, your encrypted data will be permanently inaccessible.

Self-Custody: You are in full control of and responsible for your cryptocurrency private keys and encryption keys.
Transaction Responsibility: You are responsible for all transactions you initiate, including verifying data before uploading to Arweave.
Data Permanence: Data uploaded to Arweave is permanent and cannot be deleted.
Legal Compliance: You agree to comply with all applicable laws in your jurisdiction.

5. Acknowledgment of Risks

The Service is provided "as is" and "as available" without any warranties. We disclaim all liability for any loss or damage arising from:

Loss, theft, or compromise of your encryption keys or private keys
User error, such as uploading incorrect data or losing encryption keys
Failure of any third-party service (iCloud Keychain, Arweave network)
Regulatory changes or enforcement actions
Future cryptographic breakthroughs

6. Service Continuity

The Service is architected to minimize reliance on the Developer. If Q-Ledger ceases operations, we provide publicly documented recovery scripts on GitHub. Standard users require the Q-Ledger app for decryption. Pro users who exported their ML-KEM-768 keys can use recovery scripts on any platform.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL AERNOUD DEKKER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF CRYPTOCURRENCY, DIGITAL ASSETS, ENCRYPTION KEYS, DATA, OR PROFITS. TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED $100.00 USD.

8. Intellectual Property

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Q-Ledger application for your personal use. All rights, title, and interest in the Service remain the exclusive property of Aernoud Dekker.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the app or our website. Your continued use constitutes acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by the laws of The Netherlands. Any dispute shall be resolved by arbitration in Amsterdam, The Netherlands, before a single arbitrator administered by the Netherlands Arbitration Institute (NAI).
